‘You Make Laws Instantly, you Can Run Through Impact of Laws too’: SUPREME COURT

Supreme Court bench with Justice Sanjay Kishan kaul & Hrishikesh Roy, on Wednesday while hearing a Suo-Moto case with regards to the vacancies in NCDRC & SCDRC’s, noted that there are 3 vacancies in NCDRC and thus directed the government to fill-up such with the period of 8 weeks. Further the bench also ordered to conduct a legislative impact study of Consumer Protection Act,2019 with the period of 4 weeks. 

While replying to the second order passed by the court, Aman Lekhi, Additional solicitor General, who was appearing on the behalf of the central government in the court stated that the period of 4 weeks to conduct a survey is not sufficient. And he further stated that the terms of appointment of NCDRC bench is to be done as per the timeline given under Tribunal Reform Act,2021.

However, the bench stated to the contrary that “when one has will to do something, then there is no confusion and further stated that you are making legislation instantly, in a rush now at least focus on the post requisites.”

During the proceeding, an amicus curiae, Aditya Narain, informed the court that the out of the bench of 7 members in NCDR 3 are remaining only. Thus, while hearing all the propositions the court directed the government to fulfill all the vacancies with the given period.
