Anoop Kumar Singh & Anr v. State of UP & others
Allahabad HC dismissed petition on re-evaluation of the answer sheets. The Uttar Pradesh Higher Education Service Commission promoted it’s vacancies in several subjects. The petitioner was one of the applicant for filling the vacancy post of Assistant Professor in Geography subject. After he wrote the examination for the same, the answer key was published by the commission noting that any objections can be raised against if found wrong answers.
The petitioner found 10 answers wrong and filed an objection against the commission. The objection was ignored and the results were declared, due to which the petitioner failed to succeed. Challenging this petition was filed in the Allahabad HC to direct or redirect the re-evaluation of the answer sheet.
This decision by the commission is arbitrary and hard-heartedness the petitioner added. The court said that the burden of proof depends on the petitioner to prove that the answer key is wrong but then should also include the glaring mistake and the reasoning behind it.
The HC observed that the decision by the academic experts is best suitable to be taken by the high expert in such fields itself so it stated that it won’t be hearing such cases and denied to direct or redirect for re-evaluation of the answer sheet.
Thus the case was dismissed.
