SC denies stay on 25% reservation for Karnataka students in NLSIU

On 2nd July 2021, Supreme Court declined the stay on 25% horizontal reservation for Karnataka students in National Law School of India University (NLSIU). However, CLAT (Common Law Admission Test) will be conducted on its scheduled date i.e., July 23.
The stay order was made in response to special leave petition filed by Karnataka. The petition questioned October 2020 judgment of Karnataka High Court regarding 25% reservation for Karnataka students. Petitioner Senior Advocate Gopal Shankaranarayan asserted that through this way Karnataka High Court judgment would be questioned.
In order to reply to this, General Prabhuling Navadgi proposed that the amendment got struck down by High Court because legislature lacks the authority to initiate reservation for students in NLSIU. However, High Court agreed upon Executive Council of the NLSIU’s authority to bring in reservation. Thus, NLSIU initiated reservation.
The argument was further done regarding not filing the PIL in college admission disputes. Senior Advocate further declared that “last-minute adjustments” shouldn’t be done to admission requirements. In this, he spotlighted upon the last year’s judgment of Supreme Court where it busted upon last minute changes made by NLSIU regarding NLAT.
Bench posted the matter for August and declared to conduct the exams.
The University acknowledges the students who have not studied for less than 10 years in a reputed institution as “Karnataka Students” and will provide them 25% reservation for academic year 2021-22.
The reservation is applicable to B.A, LL.B (Hons) and LLM programmes which have the intake capacity of 120 and 50 respectively.
