Interim Relief for Salman Khan’s Radhe: Delhi High Court orders blanket protection against Piracy.

In the case, Zee Entertainment vs. Tajendar Modi & Ors a single bench of Justice Sanjeev Narual of Delhi HC directed WhatsApp and other social media platforms to immediately suspend accounts that are illegally sharing or selling pirated copies of the movie.
A suit was filled when the plaintiff received the information that the film “Radhe: Your Most Wanted Bhai” was a victim of rampant piracy through social media platforms including messaging app ‘Whatsapp’. The plaintiff further submits that Whatsapp LLC has been informed about the infringing copies of the film being shared without permission, violating the terms of service of WhatsApp restricting its user to violate copyright infringement caveating ultimate termination of accounts.
On this account the court observed, the evidence clearly suggests that the accounts in question are ex-facie being used in complete voilation of terms of service of the Whatsapp and the same shall be suspended not later than 24 hours from the reciept of the request from the plaintiff.
Further, the court restrained the parties from unauthorisedly storing, reproducing, communicating, disseminating, circulating, copying, selling, offering for sale, or making available copies of the film that may infringe the plaintiff’s copyright.
The court concluded that the plaintiff has established a prima facie case in its favor as an irreparable loss would be caused if an ex-parte interim injunction is not granted.
