Facts:

As the first state to do so, Uttarakhand establishes a uniform set of rules that regulate many facets of civil life. The law is the result of lengthy deliberation, with a five-member group led by former Supreme Court Justice Ranjana Prakash Desai giving its final report. It consists of 392 parts spread across seven schedules. The law seeks to provide equality amongst people, particularly with regard to issues of marriage, divorce, inheritance, and cohabitation. The Act’s potential to lessen women’s oppression and promote social peace was highlighted by Chief Minister Pushkar Singh Dhami in his statement of delight in its passage.

Reason for surfacing:

As Uttarakhand takes the lead, conversations on the value and ramifications of a common legal system regulating personal affairs across a range of religious and cultural perspectives are reignited.

Effect:

Uttarakhand’s adoption of the Uniform Civil Code is expected to have a wide range of implications for the nation. Supporters hail it as a positive step toward social peace and gender equality, but detractors worry that it would violate cultural customs and individual liberty. The application of the law may result in legal uniformity, but it may also give rise to legal difficulties and cultural conflicts. Furthermore, there is still much disagreement about how it affects personal relationships and customary rules, two areas in which individual liberties are most affected. The nation’s socio-legal environment is expected to be affected by Uttarakhand’s legislative milestone, influencing future conversation and policies as other states take note of its actions.
