Facts of the Case:
Responding to a writ suit brought by Gurpreet Singh of Bijnor district, the Allahabad High Court this week ordered the District Magistrates of Bijnor (Uttar Pradesh) and Haridwar (Uttarakhand) to erect pillars marking the state boundaries across the two states. Because of ambiguities and disagreements over state borders, the petitioner claimed that Uttarakhand authorities had unlawfully interfered with his ownership and production of agricultural property.
Gurpreet Singh requested judicial assistance, claiming that his land is solely inside the State boundaries of Uttar Pradesh. The petitioner asked the Court to order the geographical department of the Survey of India to appoint an expert committee to draw the borders in conjunction with revenue officials from both districts.
Arguments Presented by Parties:
The Deputy Advocate General for Uttarakhand and the Standing Counsel for UP concurred that the matter may be handled by revenue officials. Consequently, the Court directed the District Magistrates to appoint suitable revenue teams and Sub Divisional Magistrates. On January 23 at noon, these teams—along with the petitioner—will visit the villages of Himmatpur Bela, Tehsil, and District Bijnor in order to identify and demarcate the uncontested border.
The Court permitted the placing of demarcation pillars upon conclusion of the delineation in order to identify contested areas lying inside Uttarakhand. During the demarcation procedure, the petitioner was ordered to leave any land in UP that was shown to be unlawfully acquired.
