Allahabad High Court Grants Interim Bail for Marriage in POCSO Case Amid Controversy over Victim’s Age

The Allahabad High Court granted interim bail to an accused in a case under the Protection of Children from Sexual Offences Act (POCSO Act) to facilitate his marriage to the complainant, despite objections from the State regarding the girl’s age.

The accused, who has been in custody since January, asserted innocence and cited a consensual relationship. The complainant confirmed her desire to marry him. The accused was released until July 3, under the condition that he marries the complainant within 15 days of his release.

The court mandated that the marriage must occur within 15 days of his release, with registration following within the same timeframe. The Registrar of Marriage was directed to promptly register the marriage upon completion of all necessary formalities. The marriage certificate was to be produced by the applicant and prosecutrix before the court on July 3.

Court also said that any violation of the bail conditions would lead to its automatic cancellation, with potential repercussions upon complaint from the victim or her family.
