Bar Council of India Urgently Addresses Advocates’ Verification Concerns

The Bar Council of India (BCI) has recently issued an urgent notice to address concerns and apprehensions regarding the Advocates Declaration of Existence in the legal profession. The notice emphasizes the importance of accurate information and proper documentation during the verification process, highlighting the need for transparency and adherence to established guidelines.
The notice clarifies that contrary to any previous communications from State Bar Councils or individual advocates, it is imperative for advocates, including those listed as voters in previous Bar Council elections, to substantiate their existence in the legal profession during verification. This verification process requires the submission of essential documents such as vakalatnama, order sheets, or proof of drafting/deeds for non-litigious work, in accordance with the Bar Council of India Certificate and Place of Practice (Verification) Rules, 2015.
The BCI stresses the significance of correcting any incorrect declarations promptly, arising from inaccurate information provided by applicants. Advocates are urged to meticulously review and rectify their submissions, aligning them with the established guidelines. The BCI also directs the State Bar Councils to promptly reiterate this aspect to all applicants to ensure compliance.
To facilitate compliance with Form A Column III, advocates are reminded to submit certified copies of at least five Vakalatnamas or any other document that establishes five years of active practice. Law firm-associated advocates are required to provide a certificate from authorized personnel detailing the period of service and nature of work. Conveyancing lawyers must submit five documents from the last three years supporting their claim of being a conveyancing practice lawyer.
In addition to these documents, the notice instructs advocates to provide details and updates on educational qualifications and disclose any filed or pending criminal cases. This comprehensive approach aims to ensure a thorough and accurate verification process, fostering transparency and accountability within the legal profession.
