The Maharashtra government was pulled up by the SC for not filing an affidavit

The SC pulled up the Maharashtra government for not filing an affidavit regarding the details of the compensation to be given in a case, wherein the state had illegally occupied a person’s property and the person was rather allotted a notified land.
The bench comprised of Justices BR Gavai, Sandeep Mehta and KV Viswanathan.
The application was filed by a litigant whereby her claimed that his predecessors-in-interest purchased a 24 acre land in Pune in the 1950s.
A statement was made by the state that the land has been given for the defense institute.
The institute had said that it was not a party to the dispute.
The applicant had moved to the Bombay HC, praying that he would be allotted alternative land.
Eventually, it was finally allotted.
However, the central empowered committee informed that the land was part of the notified forest area.
The court asked the state to file the affidavit as:-
- As to whether another piece of equivalent land will be offered
- As to whether adequate compensation would be paid
- As to whether the State Government proposes to move the Central Government to denotify the said land as forest land.
The same was not filed, so the court said that if the same is not filed before the next hearing, then the chief secretary will be present.
