The Kerala Story accused of encouraging hate speech, petition filed in Supreme Court; court rules, must file at High Court first

Issue – The Kerala Story, a forthcoming film, is being sued to prevent its distribution because it allegedly encourages hate speech, according to the Supreme Court petition.

Facts of the case – In the Hindi movie The Kerala Story, a group of ladies from Kerala enlist in the Islamic State of Iraq and Syria (ISIS). 

The movie has drawn criticism, with both the CPI(M), which is in power in Kerala, and the Congress, who are in opposition, claiming that it is a propaganda film that promotes the untrue story and agenda of right-wing parties.  On Friday, May 5, the movie is scheduled for release.

Arguments – The defendants said that during the break, the bench is free to just read the transcript. 16 million people have already watched the trailer. We’ll submit a big petition by the next day.

Reasoning – Due to the fact that the current action includes the Central Board of Film Certification (CBFC), a statutory body that certifies films, the subject cannot be brought as an interim application in the currently ongoing case.  He said that the appropriate High Court should be contacted first and that, as a result, a different petition would need to be submitted.

Judgement – The bench stated that the High Court should have received the petition first.
