Union Requests Supreme Court To Consider Previous Ruling for Disqualified MP’s Conviction

The Supreme Court in India has ruled that the conviction of disqualified Lakshadweep MP Mohammed Faizal in an attempt to murder case can be disposed off in terms of the recent judgement passed in the case of BSP MP Afzal Ansari. The matter was listed before Justices Hrishikesh Roy and Prashant Kumar Mishra.
Additional Solicitor General KM Natraj highlighted that a three-judge bench had recently passed an order regarding the suspension of conviction, which could be disposed off in the same terms as the case of BSP MP Afzal Ansari.
The Division Bench ordered that Mr. Sibal, senior counsel, submit that this Court has also suspended the sentence of conviction. Mr. Natraj, the ASG, submitted that recently, on 12.14.2023, this Court passed an order and may consider this present matter in light of this order.
Mohammed Faizal was convicted by the Trial Court for attempting to kill Mohammed Salih, son-in-law of former Union Minister P. M. Sayeed, during the 2009 Lok Sabha polls. He was elected as a Member of Parliament in 2014 and again in 2019. Against the punishment, Faizal and others approached the Kerala High Court.
The Supreme Court remanded the matter back to the High Court for reconsideration within six weeks. On October 3, a single bench of Justice N. Nagaresh refused the suspension of his conviction. The High Court emphasised the grave concern of criminalising the election process.
The Court granted time for Mohammed Faizal to examine the matter and listed it after two weeks.
