Traffic Concerns do not Justify Denial of Permission for Political Rallies: Madras HC

The Madras HC has recently said that mere hindrance to the traffic and free movement of the people does not equate to a ground for the rejection of the permission of the political rallies.

Justice K Murali Shankar of the Madurai bench of the Madras HC gave direction to the Trichy police and the Assistant Election Officer who were concerned for the permission of the BJP national president J.P Nadda’s 2.5-hour-long rally in Trichy Tamil Nadu.

A plea was moved by the BJP district secretary Rajasekaran whereby the April 6th order of the assistant officer was challenged. By this order, the assistant election officer had refused to grant permission for the rally citing traffic chaos.

It was told by the police and the local authorities that such a rally would obstruct the traffic as there was a temple festival going on.

It was observed by Justice Murali Shankar that the same is not a good ground for rejecting the permission for the rally as long as the same is peaceful.

The assistant election officer’s order was set aside.
