Supreme Court Seeks Regulation of Obscene Content on YouTube and Social Media

In light of the controversy surrounding the show “India’s Got Latent”, the Supreme Court on Tuesday (February 18) expressed concerns over the lack of regulation of obscene content on YouTube and other social media platforms.

The Court inquired about the Union Government’s stance on the matter and emphasized its willingness to take action if necessary. 

A bench comprising Justice Surya Kant and Justice N Kotiswar Singh conveyed these concerns to Additional Solicitor General (ASG) Aishwarya Bhati, highlighting the regulatory “vacuum” in online content oversight.

The Court called for the assistance of Attorney General for India R. Venkataramani and Solicitor General Tushar Mehta, underscoring the need for a structured approach to address the issue. 

The observations were made in connection with a petition filed by YouTuber Ranveer Allahabadia, who challenged the FIRs registered against him for alleged obscenity.

While granting him interim protection from arrest, the Court criticized the language used in his show.

The Union Government, being a respondent in the case, was also issued a notice. 

Justice Surya Kant, addressing ASG Bhati, urged her to communicate the Court’s concerns to the Attorney General and Solicitor General, stating that regulatory action was necessary. “There was this case involving YouTubers… The Government of India is a party to it… We want to take steps in this regard. If the Government initiates action, we would welcome it. Otherwise, we cannot ignore this issue, considering the way some YouTube channels are misusing their platforms,” the judge remarked. 

The matter is set for further hearing, with the Court making it clear that it will not overlook the significance of regulating online content.
