“The Supreme Court orders the Western Bengal Government to pay ₹ 10 Lakh to employees retired by a delayed pension”

The Supreme Court recently imposed a cost of ₹ 10 Lakh in the state of Western Bengal for presenting a delayed and founded petition against the legitimate withdrawal fees of an employee, who had remained without paying for 18 years. The cost went to be paid to the retired employee (defendant in the case).

A bench that includes Judges Vikram Nath and Sandeep Mehta listened to the case that involved a retired employee who had not received his retirement quotas since his retirement in 2007. The appellant-state of West Bengal Superior Court of Calcutta, which had annulled. The disciplinary procedures against the defendant and ordered the State to release their quotas withdrawal with long data.

The terrible experience of the respondent began in 1989 when disciplinary procedures against him began. It was exonerated in 1994. However, in 1997, a cause of cause that proposed punishment was issued. The respondent responded, but no more measures were taken. Then, thirteen years later, in 2010, three years after its retirement in 2007, the State issued a second cause of cause for the same alleged misconduct.

Challenging this notice, the defendant brought the matter to the Superior Court of Calcutta, which finally ruled in his favor by annuling the disciplinary procedures and ordering the State to release his retirement fees. Then, the State appealed this decision before the Supreme Court with a substantial delay of 391 days.

At first, the Court expressed its dismay for the action of the State to relive the disciplinary procedures years after the retirement of an employee, especially for the same reasons as the previously completed consultations.

“Taking note of the facts, as recorded above, it is unfortunate that the person, who retired in 2007, even after 18 years, has not yet been paid his retirement fees and only receives a provisional pension,” the court observed .

“In the previous facts of the case, we dismiss these requests presented by the Western Bengal state by delay, as well as by merits and also impose costs of Rs. 10,00,000/- (only ten Lakhs alone), A, to be paid to the demanded within four weeks as of today. In addition, all pending withdrawals will be paid within the same time, ”added the court.

Consequently, the appeal was dismissed.
