
Student certificates must have the mother’s name, unrealistic and archaic if not followed: Delhi HC

A student Ritika Prasad had approached the court on the issue of the degree issued, bearing the name of only her father and not her mother.
Analysis:- It has been held by the Delhi HC that the names of the mother must also be reflected in the certificates and the degrees as well as other educational documents wherever the name of the parents is required.
It was observed by Justice c Harishankar that, if the daughter and the son both are entitled to be treated with equality of recognition then in the same manner, both the mother and the father of the child must be given equal recognition.
If the same is denied or questioned then it will be archaic and unrealistic.
The court also said that, as per the facts, in today’s time almost 70 percent of students who pass law school are girls.
He said, “The artificial gender-based mental distinction that we have, over ages, drawn, based on a chance chromosomal circumstance, is now all but effaced. If there is still, among us, anyone who retains that mental block, it is time he woke up and smelt the coffee.”
It was also noted by Justice Hari Shankar that as per the circular issued by the UGC in 2014, the educational documents are mandated to have the names of both the mother and the father.
Conclusion:- The court then ordered the Guru Gobind Singh Indraprastha University to include the name of both the father as well as the mother of the student Ritika Prasad who has completed her BA.LLB degree from Amity University.
