Sex Education and Surrounding Misconceptions

A bench comprising of CJI DY Chandrachud and Justice JB Pardiwala observed that the common belief that sex education is a Western concept, in a non-alignment with traditional Indian Values, has led to resistance by many state governments. As a result, sex education is banned in some states.

This has further led to the hindrance of the comprehensive sexual health program.

Observations

The SC had also held that the mere possession of Child pornographic materials would constitute an offense and suggested the replacement of the word “child pornography” with child sexual exploitative and abusive material.

The court went on to observe that the misconceptions around sex education is widespread, which eventually leads to limited implementation.

One of the most common misconceptions is that it would promote promiscuity rather than awareness among the youth.

The court emphasized age-appropriate sex education that can prevent youth from engaging in harmful sexual behavior.

Any kind of child sexual exploitative material also is degrading for the dignity of the children, and the impact of such acts on the victims is devastating.

The court suggested that compassionate and comprehensive support is crucial for such victims.
