SC should sit in larger bench composition to prevent conflicting judgements: Justice Dr. S Muralidhar

Senior Advocate and former Delhi and Orissa High Court judge, Justice Dr. S Muralidhar viewed that the supreme court should sit in larger bench compositions to avoid conflicting and varying judgements. 

“It has 17 two-judge benches, leading to inevitable differing interpretations. Larger bench formations are necessary to reduce conflicts among benches, and decisions should be revisited only in cases of serious disagreement. Addressing the workload, he highlighted the mental fatigue associated with the demanding cerebral work, noting, The brain is extremely tired, leaving little time for reflection, and increasing the likelihood of mistakes.” Mr. Muralidhar said. 

Mr. Muralidhar was delivering 30th JP Naik Memorial Lecture titledTime to Introspect, Revisit: 50 Years of the Committee on the Status of Women in India” where he discussed the history, findings of the committee. While giving the lecture, he opined that the court should avoid reviewing the established judgements unless the matter is of significant importance, where the views and legal interpretation of judges are dissenting. 

He further expressed concern for more detailed reports from the National Commission for Women, noting recent reports as lacking in specifics regarding the types of crimes addressed.
