SC directs to decide the disqualification petitions by 31st Dec and 31st Jan

On 30th October, SC directed the Maharashtra Legislative Assembly speaker to make decisions regarding the petitions filed in relation to the rift between Shiv Sena and Nationalist Congress. The court directed to decide the petitions by 31st December 2023 and 31st January respectively.

The bench was led by CJI DY Chandrachud, was hearing the petitions filed by Sunil Prabhu, who is a member of Shiv Sena, and Jayant Patil who is a member of NCP, seeking expeditious decisions by the speaker on the disqualification petitions.

Displeasure was expressed by the bench on the stand that was taken by the speaker, which was that he wanted time till 29th February 2024 to decide the disqualifications.

On an earlier occasion also, the speaker was told to complete the proceedings as soon as possible. When an extension was sought again, the bench expressed surprise.

Though Solicitor General of India Tushar Mehta has said that proceedings will be completed by 31st January, he added that with the Diwali vacations, the same seems to be unrealistic but the bench was firm in its stance.
