Fake Encounter In Assam Is Not Good For “Rule Of Law” Filed A Plea Against In Supreme Court

The SC Bench of Justice Ujjal Bhuyan and Justice Surya Kant heard the SLP against the Gauhati HC order, Where the PIL raised the same issue of over 80 fake encounters in Assam was dismissed.
HC’s view was that no separate probe into the alleged incidents was required, as state authorities were investigating each case.
Justice Ujjal Bhuyan remarked that the accused person lost their lives in the alleged manner which is not good for the rule of law.
The petitioner filed affidavits of the victims of the Tinsukia encounter case in which three persons were injured in police firing in 2023. The affidavits contain narration by the victims of the encounter where they have stated that the encounter was fake and it was done intentionally by the then SP Mrinal Deka and other police personnel
When counsel for state Senior Additional Advocate General for Assam Nalin Kohli said that not a single police personnel, who was involved in an encounter, has been promoted, Justice Bhuyan said that it is not a good thing for the rule of law that so many accused are losing their lives like that.
Kohli stated that it is in the process of filing an affidavit today as directed by the court and after hearing both the parties the court adjourned the matter till October 22.
It is to be noted that the government didn’t file an affidavit till date for the last two dates. Prashant Bhushan, Advocate-on-record and civil rights activist appeared on behalf of the petitioner. He seeks an inquiry by an independent agency, like the CBI, SIT, or a Police team from other states.
The petitioner alleged that the officer in charge of police station dholla appointed himself as an investigation officer in this case, even though he was present at the scene of the encounter with his pistol which was snatched by victim Deeojyoti Neog.
