On Monday, displeasure was expressed by the Supreme Court as the advocates were restrained from approaching the court for the recovery of the legal fees as they were representing the state government.
The plea was filed by the state of Uttar Pradesh against the order of the Uttarakhand HC that had directed the state to pay the interest on the outstanding fees of the advocate.
The bench was headed by Justice Abhay S. Oka and Justice Pankaj Mithal.
The court said that it was very unfortunate that the advocates representing the state had to approach the court of law for the recovery of the fees.
It said that the state should lay down a clear policy for the same to ensure that the advocates appearing for the state are paid the fees due to them.
The respondent in the matter was an advocate who was appearing in the Uttarakhand HC for the payment of his outstanding fees from December 2009.
It was directed by the HC to pay him the amount at an interest of 8 percent per annum.
