“It is the duty of the police authorities to produce the accused before the Trial Court”: Supreme Court while granting bail to the accused.

Recently, the Supreme Court while granting bail to the accused, observed that it is the duty of the police department to produce the accused before the trial court and that the accused cannot be blamed for the police’s negligence.

“Since the petitioner is in prison, therefore, it was the duty of the police authorities to produce him before the Trial Court. The petitioner cannot be blamed for the negligence on behalf of the police authorities.” The order said.

The bench comprising Justices BR Gavai and Prashant Kumar Mishra, was hearing the special leave petition (Satendra Babu vs. State of Uttar Pradesh) challenging the bail application of the accused on the ground that the petitioner did not appear before the trial court and such warrants came to be issued. The accused was behind bars for one year and four months, and the chargesheet was already filed.

Thus, the petitioner is directed to be released on bail and the special leave petition is disposed of accordingly.
