Faith cannot affect the right of a person to marry: Delhi HC

Issue:- A petition was filed by an interfaith couple who were facing threats of marrying against the wishes of their family.
Analysis:- Faith cannot be a cause to be affecting the life partner a person chooses for themselves. The right to marry is an incidental aspect of human rights, as pointed out by the Delhi HC
The UDHR has already highlighted the right to marry a person of one’s choice as well and it is also an integral facet of Article 21.
Justice Saurabh Banerjee said that the constitution guarantees every individual autonomy with respect to these matters.
It was said by the HC that, the state, society, and not even the parents can dictate the choices of the person to choose their life partner or curtail the rights too.
The court said that the parents of the woman cannot be permitted to threaten the couple
The court said that Article 21 protects the right of a person, to marry the partner of their choice.
Judgement:- The petition was allowed by the court and it was directed by the court to provide the contact numbers of the police officials, who can provide help to the couple when it is sought.
