Electoral Bond Case Hearing:- Day 2

The case is currently being considered by a panel of judges, with Chief Justice DY Chandrachud presiding, and Justices Sanjiv Khanna, BR Gavai, JB Pardiwala, and Manoj Misra also part of the bench.

Advocate Prashant Bhushan, representing the Association for Democratic Reform, began presenting the petitioners’ case yesterday. He argued that the modifications made to the FCRA, RPA, Income Tax Act, and Companies Act infringed upon citizens’ right to access information and encouraged corrupt practices.

Yesterday, Senior Advocate Kapil Sibal, along with Advocate Shadan Farasat representing CPI(M), and Advocate Nizam Pasha, presented their arguments.

During the proceedings that took place yesterday, the Supreme Court made remarks about the absence of regulation over transactions related to Electoral Bonds due to the transferable nature of these bonds.

On Wednesday, during the hearing, the CJI said that, if, however, the intention was genuinely to implement such a scheme for fair competition, then all of these donations should be donated to the Election Commission of India for subsequent equitable distribution.

To this, the SG replied that, in that case, there may be a decrease in contributions, and everything may become cash-based.
