Convict sought review of the verdict of SC: Bilkis Bano Case

One of the convicts of the Bilkis Bano gangrape case has moved to the SC whereby he had challenged a judgement given by the which had cancelled his remission that was granted by the Gujarat Government.
The convict, Ramesh Chandana, through his advocate Pashupati Nath Razdan, had argued that by doing so, the SC had overruled the decision of another division bench, which is not permissible.
In the 8th January judgement, the bench of Justice BV Nagarathna and Justice Ujjal Bhuyan had concluded that the policy of remission that applied to the convicts was the remission policy of the state of Maharashtra and not of Gujarat.
Which meant that the state government of Gujarat had no authority to grant the remission.
It has been contended by him, that the judgement which was given in May 2022 cannot be set aside until a curative petition has been filed to the same.
