Congress Spokesperson Surjewala Gets Extension, NBW Execution Postponed for 5 Weeks

The National Spokesperson of Congress, Randeep Surjewala, is the subject of a non-bailable warrant. The Supreme Court has ordered that the warrant not be executed for the next five weeks. Surjewala was given permission by the bench consisting of CJI DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra to move to the trial court with an application to revoke the warrant against him for five weeks.

Senior Advocate AM Singhvi brought up the matter urgently before the bench and it was taken under consideration, even though it was not listed in the other category today.

A Varanasi Special Judge issued the warrant on November 7, 2023, directing Surjewala to appear in court on November 21 in relation to a case involving alleged political agitation that dates back to 2000, during which time Surjewala was a leader of the youth Congress.

Singhvi, representing Surjewala, argued that the court had not provided him with legitimate copies of essential documents, including medical records. Surjewala moved to the Allahabad High Court under Section 482 CrPC, which reserved its judgement for October 30, 2023. However, non-bailable warrants were issued against him.

Singhvi contended that since he was actively participating in the Madhya Pradesh assembly elections campaign, warrants could not have been issued against him and that the High Court had improperly denied the urgent mention and listing of the case.

The petitioner is allowed to move an application for cancellation of the NBW to trial court within four weeks of the Supreme Court’s ruling that it is not necessary to notify the respondents at this time.
