Central Government Challenges Pankaj Bansal Ruling, News Click Editors Appeal To Delhi High Court Over UAPA Detention

The Central Government will challenge the recent Supreme Court decision in Pankaj Bansal v. Union of India in a review petition that will be submitted soon. This decision held that the ED must notify the grounds of arrest in writing and that merely refusing to comply with a summons is not a ground for arrest.
In the News Click case, Tushar Mehta, the Solicitor General of India, advanced this argument before the Delhi High Court.
Editor-in-Chief of NewsClick Prabir Purkayastha and Human Resources Director Amit Chakraborty have petitioned the Delhi High Court to have their arrests in the UAPA case involving suspected Chinese financing overturned. The court is now examining their arguments. Using the Pankaj Bansal ruling, they contested the arrest on the grounds that the arrest’s justifications had not been disclosed.
In a retort, Solicitor General of India Tushar Mehta argued on behalf of the Delhi Police that the Pankaj Bansal decision would not apply to the current arrest, which occurred on October 3, as the judgement specifies that it will apply “henceforth” and was posted on October 4.
