Caregivers can’t work all day: Kerala Administrative Tribunal

It has been held by the Kerala administrative tribunal at Thiruvananthapuram, that forcing ayyahs, to work round the clock without giving them a proper break was arbitrary as well as violative of the right to life under Article 21.
The tribunal ordered that the work timings of the caregivers must be limited to 8 hours a day as well as 48 hrs a week and simultaneously execute a shift-based system.
It also asked the concerned superintendents of the institutions to implement the modified working hours through appropriate changes.
A plea was filed by 5 ayahs who were working at the senior citizens and mentally deficient children which was run by the state’s Department of Social Justice.
It was alleged that they were forced to work 24 hours a day for 6 days a week.
The bench of Justice PV Asha as well as Dr. Pradeep Kumar granted the caregivers relief and emphasized the fact that the state cannot deny humane working conditions to the ayyahs.
