The court’s judgment was impacted by a previous ruling dated October 16, 2023, in which Justice Bibek Chaudhuri instructed that the writ petition in question be overseen by Justice Suvra Ghosh. Despite this direction, the attorney for the petitioners was accused of being belligerent and attempting to intimidate and disrespect the court.

Arguments Presented by Parties: The petitioners’ lawyer was accused of acting hostilely and seeking to persuade the court. The advocate’s actions were regarded as a violation of etiquette and a clear challenge to the court’s authority.

Reasoning: In its decision, the court took a firm stand against the advocate’s improper actions. The court observed that the advocate’s behavior was not consistent with the legal system’s required respect and professionalism. Such activities can damage the court’s credibility and disrupt the legal process. In considering this, the court opted to fine the counsel Rs. 50,000.

Judgment: The counsel defending the petitioners was fined Rs. 50,000 by the Calcutta High Court. This fine will be payable to the High Court Legal Aid Services Authorities as a deterrence to disruptive and disrespectful behavior in court. The decision emphasizes the necessity of preserving civility and professionalism in the field of law and during court hearings.
