Allahabad HC’s order on the appointment of a commissioner to inspect Shahi Eidgah Masjid stayed by SC

On Tuesday the SC stayed the Allahabad HC’s implementation order, where it appointed a commissioner for the inspection of the Shahi Eidgah Mosque at Mathura in the Krishna-Janmbhoomi Case.

The bench comprised of Justices Sanjiv Khanna and Dipankar Datta passed the interim order while a notice was also being issued on a special leave petition which was filed by the mosque committee against the Allahabad HC’s 14th December order.

It was argued by Advocate Tasneem Ahmadi that the HC could not have passed the order when an application that was filed seeking the rejection of the suit as to be barred under the Places of Worship Act, was already pending in the court.

Senior Advocate Shyam Diwan who was appearing on behalf of the Plaintiff objected to the stay of the order.

Justice Khanna said, “We have reservations about the application. Look at the prayer. It is so vague. Read it. You cannot make an omnibus application like this. You must be very clear about what you want the local commissioner to do,”

The bench issued notice on the petition.
