Accused’s matter transferred in ED case, alleged bias

Rouse Avenue Court’s principal district and sessions judge, transferred the Bhushan Steel Money Laundering case, from one judge to another after the allegation was made by the accused that the judge was ‘probably biased’ in favor of the ED as he had remarked, “ED matters main kaun si bail hoti hai”
Principal District and Sessions Judge Anju Bajaj Chandna, by an order passed on 1st May, transferred the case from Special Judge Jagdish Kumar to Special Judge Mukesh Kumar.
It was remarked by the judge that the apprehension expressed cannot be misconceived or misplaced.
The plea was filed by Ajay S. Mittal, whereby it was sought that the proceedings get transferred.
The proceedings were even watched by Mittal’s wife. Once the counsel left the room, an inquiry was made by the staff, to which the judge passed the comment “Lene do date, ED matters main kaun si bail hoti hai”
It was contended that, if the transfer is allowed then the confidence and credibility of the judicial system will be undermined.
The petition was considered by the Principal District and Sessions Judge. It was observed that if the petitioner does not expect an impartial hearing from the court, then due regard has to be given.
