Abstention can’t be taken from the court work, to condone lawyer’s death: SC

Supreme Court issued notice to the bar association in Odisha for it abstained from court work giving the reasons that one of the members have died. The court said, even though it is an unfortunate incident but he same cannot be a reason to bring the judicial work to a standstill.

The bench comprising Justice Sanjay Kishan Kaul and Sudhanshu Dhulia was hearing contempt proceedings against the lawyer who was accused of vandalism within the court premises.

The counsel who was appearing for the Orissa high court had informed the bench that no more strikes have been taken place after the previous order, except for the abstention in the case of an advocate’s death.

The bench said that it was unfortunate that the judicial work was brought to a standstill.

The court further asked the contemnors to come and file and affidavit that the same will not be repeated in the future.
