Supreme Court Emphasizes Judicial Restraint After Controversial Remarks Expunged

Supreme Court has urged judges to exercise restraint and responsibility when making observations during court proceedings, especially when they are live streamed. The court’s observations came after expunging the “scandalous” and “unwarranted” remarks made by a single judge bench of the Punjab and Haryana High Court against the top court in a contempt proceeding.
The five-judge special bench, headed by Chief Justice D Y Chandrachud, emphasized the need for judges to exercise restraint and responsibility in their observations during court proceedings. The bench also expunged the observations made by Justice Rajbir Sehrawat of the high court in his July 17 order. Solicitor General Tushar Mehta referred to a video of the July 17 proceedings before the high court being circulated, stating that the observations made by the single judge could cause “incalculable harm to the sanctity of the judicial process.” The bench expressed hope that such circumspection would be observed in the future.
The top court has been informed that a division bench presided over by the chief justice of the high court has taken suo moto notice of the observations and stayed his order.
