SC dismissed an SLP seeking to maintain the status quo against the demolition of the Faizyad Masjid and Madrasa, located at the Hazrat Nizamuddin, New Delhi.
It was filed against the order of the Delhi HC to direct the union in considering the allotment of an alternate plot of land which would be close to the plot in question.
It was said by the petitioner that the HC had effectively passed the order for the demolition of the said structure.
The bench of Justices Sanjiv Khanna and R. Mahadevan made the point that the religious committee recommended the demolition
On the argument of the petitioner that the land was the waqf property, it was replied by the court that it was not so.
The plea was dismissed, though it was made clear by the bench that if there would be non-allotment of an alternative worship site, then the court could be approached.
