Lok Adalat’s order was challenged in HC by IIM Udaipur directed a fee refund to the student after the cut-off date.

The IIM Udaipur filed a civil writ petition in Rajasthan HC against the order of permanent Lok Adalat. Where, directed to refund the student admission fee after the cut-off date.

Respondent first initiated the admission to IIM Udaipur and after getting an offer from another institute, the student withdrew their admission and claimed a refund of the deposit fee from IIM Udaipur with permanent Lok Adalat, Ajmer seeking resolution.

IIM Udaipur reply to fee refund dispute: institute argued that the cut-off date for refund therefore the refund was impossible, additionally, IIM Udaipur challenged the Lok Adalat jurisdiction citing the institution was in Udaipur during admission which stated that Udaipur court had the jurisdiction.

Lok Adalat ruled in favour of the respondent and directed IIM Udaipur to refund the fee along with the interest, dissatisfied with the decision, then filed a civil writ petition.

Institute counsel argued that admission was withdrawn after the seat was offered to the respondent and will be vacant throughout the year when no other student is admitted.

After considering the argument from both parties, Justice Rekha Borona’s bench granted a stay order to prevent the Lok Adalat order regarding the fee refund, from being executed and further proceeding.
