The Madhya Pradesh High Court Has Stayed The Ruling That Requires The Marriage Registrar To Record Interfaith Unions

Before being brought before the Registrar of Marriage to have her statement recorded, the Hindu woman was counseled by a single-judge bench led by Justice Vishal Dhagat to reevaluate her choice to wed the guy.

According to TOI, while considering an appeal submitted by the woman’s father, Heeralal Rathore, Chief Justice Suresh Kumar Kait and Justice Vivek Jain granted an interim stay on the order.

The couple had asked the High Court for police protection.

They announced that they were going to marry each other. After being together for four years, they informed the court that they had been living together for the past year.

On October 22, the couple was granted police protection by single-judge Justice Vishal Dhagat.

Additionally, he mandated that the woman stay at Nari Niketan until November 11.

The unmarried judge had stated that she was free to consider her choice to wed the man during that period.

The single judge had directed that she be brought to the Registrar of Marriage on November 12 to record her statement for conducting marriage under the Special Marriage Act.

She will be transferred to “Raj Kumari Bai Bal Niketan, Shastri Bridge, Jabalpur” once the aforementioned items have been collected. Said Nari Niketan will provide petitioner No. 1 with food, shelter, and a secure sleeping area. Petitioner No. 1 intends to remain there until November 11, 2024. Petitioner No. 1 will not be contacted by petitioner No. 2 or their relatives during this period. She is allowed to reflect about her choice to wed petitioner No. 2 throughout this period. The ruling dated October 22 said, “She will be taken to the Registrar of Marriage on November 12, 2024, where her statement will be recorded before the Registrar of Marriage for conducting marriage under the Special Marriage Act, 1954.”

The father of the woman then appealed the single-judge’s decision to the Division Bench.

Because it would violate the terms of the Special Marriage Act, the father’s attorney said that the Registrar of Marriage could not permit a marriage between a Muslim man and a Hindu lady.

After two weeks, the Division Bench posted the case for hearing and stayed the single-judge’s order.

Telangana BJP MLA T Raja reportedly accused the Madhya Pradesh Chief Minister of love jihad over the case and urged him to halt the marriage, according to Indian Express.
