
PIL Seeks Yogi Adityanath’s Removal for Supporting Justice Shekhar Yadav’s Controversial Remarks

A Public Interest Litigation (PIL) has been filed in the Allahabad High Court seeking the removal of Uttar Pradesh Chief Minister Yogi Adityanath. The People’s Union for Civil Liberties (PUCL) argues that the CM’s support for Justice Shekhar Yadav’s controversial statements undermines India’s secular framework.
The PIL, filed by Advocate Seema Srivastava, claims that Adityanath violated his oath of office by endorsing remarks made by Justice Yadav at a Vishwa Hindu Parishad (VHP) event. Justice Yadav had controversially stated that the nation should operate according to the majority’s wishes, using derogatory language against the Muslim community. The petition asserts that Adityanath’s comments defy constitutional principles of fraternity, secularism, and equality.
On December 14, CM Adityanath defended Justice Yadav at the World Hindu Economic Forum, asserting the need for a Uniform Civil Code (UCC). He argued that globally, the majority’s views shape governance, and India should eliminate majority-minority discrimination. On December 16, he reiterated his support in the UP Assembly, claiming that the judge’s remarks were truthful and should not provoke threats.
Justice Yadav is under scrutiny for his December 8 speech at a VHP event in Prayagraj. The Supreme Court Collegium, led by Chief Justice Sanjiv Khanna, summoned him to explain his statements. The remarks have been criticized for their communal tone and use of slurs, leading 55 MPs to seek Justice Yadav’s impeachment.
The PUCL contends that Adityanath’s defense of Justice Yadav promotes hate speech and breaches constitutional mandates. The PIL emphasizes that the CM’s actions undermine faith in the Constitution and the secular fabric of the country. The Allahabad High Court will now deliberate on the plea for Adityanath’s dismissal.
