Chhattisgarh HC Has Ruled That The Conduct Of A Wife In Insulting Her Husband’s Religion & Gods Amount to Mental Cruelty

The Chhattisgarh High Court has ruled that a wife’s insulting her husband’s religion, beliefs, and gods constitutes mental cruelty. Divisional Judge Rajani Dubey and Justice Sanjay Kumar Jaiswal said: “In Hinduism, a wife is considered a ‘Sahadharmini’ (equal partner in dharma), which cited Hindu epics like Ramayana, Mahabharata, and Manusmriti to explain that a wife is considered an ‘Sahadharmini’, sharing spiritual duties and righteousness with her husband.

The court found that the wife did not follow Hindu rituals and threatened to implicate the husband in a false case. The husband filed a divorce application under Section 13(1-A) and 13(1-B) of the Hindu Marriage Act, claiming that the wife had converted to Christianity. The court found that the wife’s testimony showed she had not attended Hindu pujas for the last ten years and disrespected Hindu rituals, gods, and sacred prasad. The court emphasized that any religious rites performed by the husband without the wife are considered incomplete.

The court ruled that the wife’s demeaning behaviour towards her husband was considered mental cruelty, and affirmed the divorce decree in Favor of the husband, despite the husband’s refusal to challenge the cruelty order.
