Allahabad HC denies bail to father-son duo for rape, betrayal.

Allahabad High Court has denied bail to Father-Son accused of raping and impregnating their daughter/sister. The court considered the case to be one of unforgivable blood and trust, stating that the charge was rare and heinous.
Justice Sanjay Kumar Singh pointed out that the hands of his father and brother, which were supposed to protect his daughter’s dignity, became weapons of her destruction. The court also referred to the decision of the Rajasthan High Court 2024 (SC) 949, which held that in serious crimes like murder, rape and theft, bail applications should not be entertained by trial courts and high courts.
In March 2019, the victim reported the company and alleged that her real brother and father had physical relations with her for 3-4 years and threatened and abandoned her when she tried to complain. She claimed that she was about five months pregnant due to the rape committed by her brother and her father. Arrested in April 2019, the brother moved the HC on long-term remand due to pending trial. Aga, for the state, opposed the prayer for bail, arguing that the victim’s allegations were corroborated by her medical examination report, which showed a 28-week and 6-day pregnancy.
The court refused to grant bail based on the overall facts and circumstances of the case, the seriousness of the offense and the role of the complainant.
