Background

The court was hearing the application for the cancellation of the anticipatory bail

It was wrongly submitted by the accused that there was a cross case regarding the same incident.

Analysis

Rajasthan HC’s Jodhpur Bench had cancelled the anticipatory bail of the air force personnel for the reason that he had misrepresented and hid the material true facts, during the grant of the anticipatory bail last year.

It was observed by Justice Farjad Ali, that the charges of grievous hurt was hidden by the accused, and the same was cited by the victim on the account of the permanent loss of vision in the left eye due to the injury that was caused by the accused.

The fact that section 326 that was added on account of the medical reports, the notice of same was not brought before the court by the accused.

Conclusion

Hence, the application for the cancellation of the bail was allowed by the court.
