Hathras stampede- SC dismissed the petition urging to form an expert committee for inquiry

Supreme Court on July 12 dismissed the petition filed under article 32 urging to appoint a 5-member committee under the supervision of retired supreme court judges to inquire about the incident.
Advocate Vishal Tiwari filed the petition following the stampede incident at Hathras which led to the death of 120 people as per the reports.
The petitioner- Mr. Tiwari asked the court to lay down guidelines for mass meetings and public gatherings. He further sought direction from the Uttar Pradesh government to submit a status report and initiate legal action who are alleged to have acted negligently.
“States should issue guidelines to prevent stampedes for the safety of the public attending such religious or other events in large numbers. States should submit reports on medical facilities available at various levels to deal with such stampedes or other incidents” the plea said.
Mr Tiwari contended that the plea has been brought before the supreme court to enforce fundamental rights particularly the right to life under Article 21 to avoid such incidents in future by ensuring essential safety measures.
Supreme court bench comprising CJI DY Chandrachud, Justices JB Pardiwala and Manoj Misra contended that the high courts are well equipped to deal with such cases and the petitioner should approach the Allahabad High Court.
“Everything does not have to come to the Supreme Court under Article 32. You can approach the High Court. They are robust courts. Of course, these are disturbing incidents. This (filing of PIL) is usually done here to make a big deal of such incidents. The high court is equipped to deal with this case. Dismissed” the court observed.
