The Delhi High Court recently ruled that baseless allegations against an arbitrator amount to contempt of court. This decision underscores the importance of protecting the integrity of the arbitration process, which serves as an alternative to traditional civil courts. The court emphasized that arbitrators must be protected from unfounded claims to ensure their impartiality and the smooth running of the arbitration.

The decision came in the context of a dispute between Dalmia Group and ATS Group. In this case, ATS Group made unsubstantiated conflict of interest allegations against the appointed arbitrator. The Delhi High Court found these allegations baseless and ruled that such actions could frustrate the arbitration process. The court noted that the referee’s unfounded accusations disrespect not only the individual, but also the court process itself.

The court further clarified that such misconduct can be dealt with under the Contempt of Court Act. This law provides a legal framework for punishing conduct that disrespects or undermines the authority of the court. By extending this protection to arbitrators, the court wants to preserve the credibility and effectiveness of arbitration as a dispute resolution mechanism.

This decision is significant to the legal community as it reinforces the need for parties involved in arbitration to act responsibly and refrain from making baseless allegations. It serves as a reminder that the arbitration process, like the judicial process, requires respect and adherence to the principles of honesty and integrity.
