Petition filed against Dr. Ambedkar Law University Ph.D. regulations mandating 2yr LLM course

Dr. Ambedkar Law University Ph.D Regulations, 2020 (Ph.D Regulations) mandates only post graduates with a ‘Two Years Master’s Degree in law to apply for a PhD. This provision has been challenged via a petition filed in Madras High Court.
The petition by Suganya Jeba Sarojini, who termed it as unreasonable and violative of Article 14 of the Constitution, also contends that this step has invalidated a valid Masters degree for the purpose of admission to Ph.D programme.
The main contention is the fact that most universities in the country have have replaced their Two-Year LL.M. Programmes with the One-Year Programme following the UGC Guidelines of 2012. These applicants holding a valid 1yr LLM degree will be denied a chance for admission.
This provision has been arbitrary and unreasonable also on the account of the fact that it will draw distinctions between persons holding the Two Year and One Year Master’s Degree without real and substantial distinction. Therefore, this is opposed to principles of administrative
petitioner prays that the Court declare the condition in the Regulations as ultra vires the Constitution and be allowed to apply for admission as an interim measure.
The matter was taken up by a Division Bench of Justices Anita Sumanth and Senthil Kumar Ramamoorthy on Thursday, who first as an interim measure allowed the petitioner to apply for admission in the Ph.D. program of the university. Hearing of the matter remains pending.
