In March 2023, the Maharashtra government informed the Bombay High Court of its decision to allocate over 30 acres in Bandra East for a new High Court complex, 20 km from the current one.
The move has sparked mixed reactions in the legal community.
While some welcome the shift to a larger, modern space, others are concerned about the inconvenience it may cause in terms of commute and accessibility for Bar members.
There’s also a sentimental attachment to the current heritage building in the Fort area, with some arguing that the High Court’s reputation is tied to its majestic architecture.
However, supporters of the move, like Senior Advocates Milind Sathe and Rajeev Chavan, see the benefits of a larger space that can accommodate the High Court complex and various tribunals and chambers.
As the transition to a new building appears inevitable, lawyers have provided input on their expectations for the new premises, which the High Court has already considered.
In a 2019 judgment, the High Court underscored its authority in determining the infrastructure necessary for effective functioning, emphasizing that only the judiciary can decide on matters such as the number of courtrooms and offices.
The judgment also outlined expectations from various bar associations.
