Lawyers are not entitled to a portion of the proceeds from legal disputes: Jammu and Kashmir High Court

Issue:- It was claimed by the litigant that the lawyer had been demanding from her, a portion of the compensation that was received by her in the case, as the professional fees.

Analysis:- It was told by the litigant to the single judge bench of justice Sanjay Dhar that she was awarded the compensation of 13.5 lakh by the Lok Adalat which was further deposited at the motor accident claims tribunal in Kathua which was supposed to be released for the litigant.

She said that the lawyer she had engaged demanded a certain percentage of this compensation, as a fee, thereby a dispute arose between the two.

She also said that given the dispute the money was not being released by the tribunal.

The court that these are serious allegations and if based on the same the tribunal is not releasing the money then this is objectionable.

Judgment:- The court ordered the tribunal to release the compensation amount immediately.

Conclusion:- If a lawyer demands from the client that a part of the rewards to be paid as the client feds then the same amounts to professional misconduct as it was observed by the Jammu Kashmir and Ladakh High Court.
