A journalist filed a criminal complaint against actor Salman khan alleging criminal intimidation in the year 2019. The metropolitan court of Andheri had before issued a summons to the act and this got challenged in the High court. It was inquired by Justice Bharati Dhangre whether the right process was followed or not.
The background of the case is that the journalist Ashok Pandey had alleged that his phone was snatched from Salman khan when the journalists were clicking his picture while cycling. He alleged that the actor had threatened and argued with him.
The investigation was ordered by the magistrate under sections 202 and 204 of the crpc. The actor as well as his bodyguard who is also an accused in this case then challenged the order in the high court.
Later some improvements were made in the complaint of the journalist to which it was said by Justice Revati Mohite Dere, while staying the summons that, being a journalist, the right statements could have been submitted in the first go.
Mr. Pandey’s advocate said that the affidavit was given by the complainant to the court which shows that the compliance to section 202 has been done and the offense has been made out based on the merits.
When the matter was being heard, Justice Revati told him that the privacy of the people should be respected, so if Salman khan is not above the law the same should be for the journalists.
Though the police report mentioned that the cases under the said offenses have been made, the same has been verified and accepted by Justice Revati and the complaint was quashed by the court.
