Nine-day Judicial Custody to Olympic Wrestler Shushil Kumar.

The Hon’ble Delhi court heard the plea of Delhi Police’s plea seeking three more days of police custody of Olympic wrestler Shushil Kumar in the CHHATRASAL STADIUM murder case.  The Metropolitan Magistrate Rashmi Gupta, Rohini Court heard the matter after the expiry of Kumar’s four-day police custody remand period.

The court passed an order quashing the plea and observed that “Remand should only be granted when the situation so warrants it and it is justified”. The court opined that Shushil Kumar had already spent ten days in police remand and that there were no grounds made out to substantiate further extension of the same.

The Additional Public Prosecutor Raghav Khurana had argued that further police custody is required to wholly recover mobile phones and clothes that the accused were wearing at the time of the incident. Since a grave incident has been committed therefore an extensive investigation is required.

Countering the arguments of the APP, the counsel for Shushil Kumar, advocate Pradeep Rana argued that the investigating agency was simply dragging the investigation to gather the attention of media and public image. He further stated that this is a matter of personal liberty. He is not a dreaded criminal, he is not a criminal at all, in fact, he has brought pride to the nation and is a victim of circumstance.

MR. Rana strongly contented that no reasonable and strong grounds were made out in the application for further police custody. There are no new grounds in the application, the previous application shows verbatim submissions and as per law, a special reason shall be made out in the application and must be reflected in the case diary.

On careful hearing of both, the arguments the “Metropolitan Magistrate refused further police custody remand citing that as per settled law PC remand should not be granted in a mechanical manner.”
