Bombay HC denies anticipatory bail to teacher who called student ‘Dharti ka bhoj’

Maharashtra high court bench denied anticipatory bail to the chairman of an international school, booked for allegedly abetting the suicide of a class 10 student.

J.Vinay Joshi while hearing the case said that “teachers can reprimand students but not in a language that could shatter their tender minds.”

In the following case the chairman of the school is held because of using filthy language against the child; the chairman, after he (diseased boy) hit a football towards a girl by mistake, this is when the accused allegedly told the deceased that he was a “Nalayak, Dharti Ka Bojh, Zhopadpattichhap etc.” after which child died by suicide. And thus, Kolhapur Police accordingly booked him for abetting suicide, intentional insult, criminal intimidation & common intention of IPC.

Justice Vinay Joshi while noting that there is a direct link of his act since within few hours from the episode, the child has ended his life by suicide,” hence, no case is made out to grant pre-arrest protection.

Justice further, remarked that the teachers can reprimand students but not in a language that could shatter their tender minds.
