In a surprising turn of events, the famous case titled as Juhi Chawla and Ors. v. Science and Engineering Research Board and Ors. has again caught attention. Bollywood actress and environmentalist Juhi chawla moved to Delhi HC today challenging the decision made by a single judge which dismissed the civil suit against 5G roll out.
The plea turned out to be defective and not maintainable and Juhi Chawla was fined with an amount of 20 lakhs. The appellants have challenged the impugned order on the ground of being arbitrary for the reason that a plaint is either rejected or returned and can only be dismissed once it has been allowed to be registered as a suit by the Court.
The appeal emerges from the civil suit which was filed by actress and others back then seeking directions to restrain the central government from taking any steps for the roll-out of 5G telecommunication services in the country, including, but not limited to steps for spectrum allocation, licensing, etc. on grounds of long and short term harm to human, animal and plant life and detrimental impact on the environment at large.
Now, the appellants have also questioned the comments given by a single judge and considering the statements were made to garner publicity. In the first hearing of this case the Court said that the appellants have failed to make out a case for leave to institute the suit or to sue in representative capacity. The latest petition will be heard by the bench of Justices Vipin sanghi and Jasmeet singh.
